What options do I have?

Please review the Courtesy Notice that was mailed to you to assist in determining which options are available to you.

I wish to forfeit bail and request my case be closed

  • Forfeiture of bail is the same as a conviction and will close the case. The bail amount as indicated on the Courtesy Notice that was mailed to you must be paid in full.

I wish to enter a Plea of Not Guilty, waive time and request a Trial by Declaration

  • If you are charged with an infraction violation, you may plead Not Guilty, waive time and request a Trial by Declaration. You must pay the amount of bail as indicated on the front of the Courtesy Notice that was mailed to you. By remitting payment and selecting this option you are entering a Plea of Not Guilty and requesting a Trial by Declaration but are waiving your right to have the case heard within 45 days of submitting this request. The declaration forms and instructions will be mailed to you. If found not guilty, or if the case is otherwise dismissed, your bail will be refunded by mail.

I wish to enter a Plea of Not Guilty, waive time and request a Trial by Court

  • If you are charged with an infraction violation and you wish to schedule a court date to contest this matter, you may plead Not Guilty, waive time and request a Trial by Court. You must pay the amount of bail as indicated on the front of the Courtesy Notice that was mailed to you. By remitting payment and selecting this option you are entering a Plea of Not Guilty and requesting a Trial by Court but are waiving your right to have the case heard within 45 days of submitting this request. You will be notified of your hearing, date, time and location by mail. If found not guilty, or if the case is otherwise dismissed, your bail will be refunded by mail.

I wish to enter a Plea of Not Guilty and request a Trial by Declaration

  • If you are charged with an infraction violation, you may plead Not Guilty and request a Trial by Declaration. I wish to enter a Plea of Not Guilty and request a Trial by Court

  • If you are charged with an infraction violation and you wish to schedule a court date to contest this matter, you may plead Not Guilty and request a Trial by Court. You must pay the amount of bail as indicated on the front of the Courtesy Notice that was mailed to you. By remitting payment and selecting this option you are entering a Plea of Not Guilty and requesting a Trial by Court within 45 days of submitting this request. You will be notified of your hearing, date, time and location by mail. If found not guilty, or if the case is otherwise dismissed, your bail will be refunded by mail.

Proof of Correction

Correctable violations will be dismissed after Proof of Correction and payment of an administrative fee ($25.00 per correction) are presented to the court by mail or in person by the appearance date indicated on the front of the Courtesy Notice that was mailed to you. Correction consists of an authorized agency signing off your correctable violation(s) by using the space provided on the back of your citation. Send the Court the original citation, the court will not accept a copy.

  • Any mechanical correctable traffic violation may be signed off by any peace officer.
  • For Insurance violations [VC 16028(a)]: Submit proof to the court showing the effective dates of the policy.
    1. Proof of insurance that was in effect prior to the issue date of your citation reduces the bail on that charge to $25.
    2. Proof of insurance that was in effect after the issue date of your citation reduces the bail on that charge to half the calculated amount, but you must also show that your insurance is prepaid for six months.
  • A registration/driver's license violation, may be signed off by the Department of Motor Vehicles, any peace officer or a current copy of the registration/driver's license can be provided to the court.

Traffic School Eligibility

You may be eligible and qualify to attend traffic school (on-line or classroom) if you have NOT attended traffic school within the last 18 months of your present violation, and do NOT have an ineligible offense under CRC 4.104(b)(2). You are not eligible if you had a commercial driver's license and were driving a commercial vehicle when you were cited. In addition, you are not eligible if the speed alleged is more than 25 miles over the speed limit.

If you wish to attend traffic school, pay the amount of bail indicated as Traffic School Bail on the front of the Courtesy Notice that was mailed to you. You must submit the amount prior to the appearance date. Your Traffic School Certificate of Completion is due within ninety (90) days of the "Appearance Date". An additional fee will be charged by the traffic school that you attend. Upon completion of a six to eight hour classroom course or an on-line course along with the submission of the traffic school completion certificate, the case will be reported to the Department of Motor Vehicles as a confidential conviction. If the court does not receive your traffic school completion certificate within ninety (90) days of the due date, it will result in a conviction on your driving record. Notice: If you are eligible and decide not to attend traffic school, your automobile insurance may be adversely affected. One conviction in any 18-month period will be held confidential and not show on your driving record if you complete a traffic violator school program.
